Please read these Terms of Service carefully before using SSH Backup. By installing, accessing, or using SSH Backup (the "Software"), you agree to be bound by these Terms. If you do not agree, do not install or use the Software.

1. Acceptance of Terms

By installing, copying, or otherwise using SSH Backup, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and all applicable laws and regulations. These Terms constitute a legally binding agreement between you (the "User") and the developers of SSH Backup (the "Developer").

If you are using the Software on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. License Grant

2.1 Software License

Subject to your compliance with these Terms, the Developer grants you a limited, non-exclusive, non-transferable, revocable license to install and use SSH Backup for personal or commercial purposes.

2.2 Scope of License

You are permitted to:

  • Install and use the Software on multiple devices you own or control
  • Create backups of your data using the Software
  • Use the Software in a commercial or enterprise environment
  • Configure the Software to connect to your own SSH/SFTP servers

2.3 Open Source Components

SSH Backup incorporates open-source libraries (SSH.NET, DotNetZip) that are subject to their respective licenses.

3. Restrictions

You agree NOT to:

  • Reverse engineer, decompile, or disassemble the Software (except as permitted by law)
  • Remove, alter, or obscure any proprietary notices
  • Use the Software for any illegal or unauthorized purpose
  • Distribute, sublicense, rent, lease, or lend the Software without authorization
  • Use the Software to violate the privacy or security of others
  • Attempt to gain unauthorized access to any systems or networks
  • Use the Software to transmit viruses, malware, or harmful code
⚠️ Important: Violation of these restrictions may result in immediate termination of your license and potential legal action.

4. User Responsibilities

4.1 Account Security

You are solely responsible for maintaining the security of your SSH credentials, API keys, and encryption passwords.

4.2 Backup Verification

You are responsible for verifying that your backups are complete, accurate, and restorable. The Developer recommends regularly testing backup restoration.

4.3 Server Configuration

You are responsible for properly configuring and maintaining your SSH/SFTP server, including ensuring adequate storage space, maintaining server security, and complying with applicable data protection regulations.

4.4 Compliance with Laws

You are responsible for ensuring that your use of the Software complies with all applicable local, state, national, and international laws and regulations, including data protection and privacy laws (e.g., GDPR, CCPA).

5. Data Privacy & Security

5.1 Data Collection

SSH Backup stores configuration settings locally in the Windows Registry on your computer. The Software does not transmit any personal data to the Developer. All data transmission occurs directly between your computer and your configured SSH/SFTP server.

5.2 Data Storage

Local Storage: Settings and credentials are stored in the Windows Registry using DPAPI encryption.
Remote Storage: Backup data is transmitted to and stored on your own SSH/SFTP server. You maintain full control and ownership.

5.3 Remote API Integration

If configured, the Software communicates with your specified API server to fetch configuration and upload logs. You are responsible for the security and privacy compliance of any remote API server you configure.

5.4 Encryption

The Software provides AES-256 encryption for ZIP backups when configured. The Developer makes no guarantees regarding the strength of encryption or protection against unauthorized access.

6. Disclaimers & Warranties

6.1 "AS IS" Provision

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

6.2 No Guarantee

The Developer does not warrant that: the Software will meet your requirements; operate uninterrupted or error-free; all defects will be corrected; backups will be successful, complete, or restorable.

6.3 No Data Loss Guarantee

The Developer does not guarantee that use of the Software will prevent data loss. You acknowledge that the Software is a tool to assist with backups, but it is your responsibility to maintain adequate data protection procedures.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of data or profits
  • Business interruption
  • Loss of business opportunities
  • Costs of procurement of substitute goods or services

8. Third-Party Services

The Software connects to SSH/SFTP servers and optionally to API servers that you configure. The Developer is not responsible for the availability, security, or functionality of these third-party services. You are responsible for selecting reliable providers and maintaining proper security.

9. Modifications

The Developer reserves the right to modify, suspend, or discontinue the Software at any time, with or without notice. The Developer may also modify these Terms at any time. Continued use of the Software after changes constitutes acceptance.

10. Termination

10.1 By User

You may terminate this agreement at any time by uninstalling the Software and destroying all copies.

10.2 By Developer

The Developer may terminate this agreement immediately if you breach any provision of these Terms.

10.3 Effect of Termination

Upon termination, all rights granted to you immediately cease. Sections relating to disclaimers, limitations of liability, and governing law survive termination.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Developer is located, without regard to conflict of law provisions.

11.1 Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration, except where prohibited by law.

11.2 Severability

If any provision is found unenforceable, the remaining provisions shall continue in full force and effect.
